Man Arrested for BWI after Crash Injures One

Suffolk County Police today arrested a man for boating while intoxicated following a crash that left one boater injured south of the Bay Shore Marina in Great South Bay.

Javier Torres was operating a 19-foot center console Key West boat when a pump malfunctioned and the vessel began taking on water. Torres brought the boat to a hard stop, filling the vessel with more water and causing it to capsize. Torres and six passengers were thrown into the water when the boat overturned.

Marine Bureau Officers Robert Reuter and Shane Parker arrived on scene and pulled two victims out of the water. The remaining five boaters were helped by Jeff Sperling, 54, and his daughters Emily Sperling, 15, and Jessica Sperling, 14, all of Bay Shore, who were tubing nearby. The two teenagers jumped into the water to bring life vests to the stranded boaters until they could be aided by the Coast Guard.

One passenger, Omar Rivera-Nelson, 31, of Brentwood was taken via ambulance to Southside Hospital in Bay Shore for treatment of non-life-threatening injuries. No other injuries were reported.

Torres, 48, of Bay Shore, was charged with Boating While Intoxicated. He is being held overnight at the Third Precinct and is scheduled for arraignment at First District Court in Central Islip on July 15.

A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
