Jury Rules in Favor of Walnut Creek in Civil Litigation

The City of Walnut Creek has been involved in a trial related to a December 2012 police response to an assault on two Walnut Creek residents that resulted in a fatal officer-involved shooting of Anthony Banta.

Today the jury in United States District Court reached a verdict in that case, exonerating the City and all officers involved.

The Walnut Creek Police Department appreciates the jury's findings in regard to this lawsuit. The four officers who responded to the 911 call back in 2012 placed their lives in jeopardy to protect two innocent people.

The jury's finding echoes what a prior investigation by the District Attorney's office found, that the four officers were justified in their actions. In addition, the judge commended the four officers (after the verdict was read) for their courage and said if not for their heroic actions that night, more lives may have been lost.

Anytime a life is lost, it is a tragedy for all of those involved. The Walnut Creek Police Department and our four officers appreciate all the support we've received from the community.
