On September 25, 2021, at approximately 9:47pm, Morgan Hill police officers responded to the area of West Main Avenue and Hale Avenue on a report of gunshots being fired.  It was determined the victim was driving west on W. Main Avenue when he was shot at by the driver of an eastbound vehicle.  The victim was uninjured; however, his vehicle was struck one time—officers located three .45 caliber shell casings in the roadway.  MHPD officers and detectives conducted a thorough investigation which ultimately led to the identification of the suspect’s vehicle and residence.
On October 22, 2021, officers from the Morgan Hill/Gilroy Regional SWAT team served a search warrant at a south Morgan Hill address.  During the search, officers located a .45 caliber handgun as well as .45 caliber ammunition.  David Soto (21 years old) was contacted at the residence and identified as the primary suspect. 
Soto was arrested on charges of P.C. 245(a)(2) – Assault with a firearm and P.C. 246–Malicious and willful discharge of a firearm at an occupied motor vehicle.  Soto was transported to the Santa Clara County Main Jail and booked into custody.
