Level II- Essential Travel Permitted- Coronavirus (COVID-19) Pandemic

WHEREAS, Chapter 3 of the Ordinance entitled “Wayne County, Indiana Emergency Management Advisory Council and Emergency Management Agency” empowers the chief executive officer of Wayne County to declare the existence or threatened existence of a local emergency or disaster to I.C. 10-14-3, particularly to Indiana Code 10-14-3-29 and; further establishes special and extraordinary powers of the chief executive officer and the Board of Commissioners for the purposes of emergency control and to protect and provide for the public safety and welfare and;
WHEREAS, Wayne County Commissioners Ordinance 2003-003, the “Transportation Emergency Ordinance of Wayne County, Indiana” provides the commissioners with authority to declare the existence or the threatened existence of a transportation emergency so as to regulate the operation and parking of motor vehicles to protect the public safety during an emergency situation and;
WHEREAS, the chief executive of Wayne County, Indiana does hereby find that the COVID-19 Pandemic which threatens the health and safety of persons and property have arisen on the date of March 17th of 2020 within Wayne County. Wayne County Commissioner's, with guidance from the Wayne County Health Department, are taking responsive measures based upon the guidelines recommended by the Governor of Indiana and the National Emergency Declaration by the President of the United States. The penalty for violation of this emergency order IC 10-14-3-34 states; A person who knowingly, intentionally, or recklessly violates this chapter commits a Class B misdemeanor.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED
IT IS FURTHER DECLARED that during the existence of said Travel Emergency, the powers, duties and functions of the emergency service organizations of Wayne County shall be those prescribed by the Wayne County Comprehensive Emergency Management Plan which is now placed in effect.
