Proclamation
of LOCAL DISASTER/EMERGENCY
 
WHEREAS, Pursuant to the powers vested in me by Chapter 251 of the Laws of 1942, as amended and supplemented, N.J.S.A. App A:9-30 et seq; N.J.S.A. 40:48-1(6) and ordinance pursuant thereto; R.S. 2-27 et seq, N.J.S.A. 2C:33-1 et seq; and all sections and subsections, I have declared that a local disaster emergency exists within the Borough of Matawan; and
 
WHEREAS, the aforesaid laws authorize the promulgation of such orders, rules and regulations as are necessary to meet the various problems which have or may be presented by such emergency; and
 
WHEREAS, by reason of the serious conditions which presently exist or will exist in the Borough of Matawan due to the global outbreak of COVID-19 which may affect the health, safety and or welfare of the people; and 
 
WHEREAS, it has been determined that the Borough of Matawan is declared a disaster area, and further, that certain measures must be taken in order to insure that the authorities will be unhampered in their efforts to maintain law and order as well as an orderly flow of traffic, and further, in order to protect the persons and property affected by COVID-19 and in order to slow the spread, be it therefore resolved that the Borough of Matawan will adopt and enforce all of the provisions listed in New Jersey Governor Murphy’s Executive Order No. 104 issued March 16, 2020, to include:
 

  1. All gatherings of persons in the State of New Jersey shall be limited to 50 persons or fewer, with limited exceptions;
  2.  All public, private and parochial preschool programs, and elementary and secondary schools including charter and renaissance schools, will be closed beginning on Wednesday, March 18, 2020, and remain closed as long as the Order remains in effect; 
  3. Institutions of higher education will cease all in-person instruction beginning on Wednesday, March 18, 2020, and shall cease such in-person instruction as long as the Order remains in effect;
  4.  The Commissioner of Education shall continue working with each public, private and parochial school to ensure students are able to continue their education through appropriate home instruction; 
  5.  The Secretary of Agriculture and the Commissioner of Education shall take all necessary actions to ensure all students eligible for free or reduced meals will continue to receive the services necessary to meet nutritional needs during closures; 
  6. All casinos, concert venues, nightclubs, racetracks, gyms, fitness centers and classes, movie theaters, and performing arts centers will be closed to the public beginning on Monday, March 16, 2020 at 8:00 p.m. and remain closed as long as this Order remains in effect;
  7.  All other non-essential retail, recreational, and entertainment businesses must cease daily operations from 8:00 p.m. until 5:00 a.m.; 
  8. Essential businesses, which are necessary for the public’s health, safety, and welfare – like supermarkets and grocery stores, pharmacies, medical offices, and gas stations – may remain open past 8:00 p.m.
  9.  All restaurant establishments, with or without a liquor or limited brewery license, are limited to offering delivery and/or take out-services only. 
  10. Effective 8:00 p.m. on March 16, 2020, all non-essential and non-emergency travel in New Jersey is strongly discouraged between the hours of 8:00 p.m. and 5:00 a.m.
 
This order will take effect immediately.
 
NOW, THEREFORE, IN ACCORDANCE WITH the aforesaid laws, I do hereby promulgate and declare that the above-cited applicable regulations shall be in addition to all other laws of the State of New Jersey, the County of Monmouth and the Borough of Matawan.
