Man wanted in pepper spray attack apprehended after short chase

A man wanted for a pepper spray attack on three people and a subsequent robbery is now behind bars, but not before leading deputies on a foot chase Wednesday, Jan. 15.
                Brandon Lee Kimbrell, 20, address listed as Jacktown Road in Marion, is charged with two counts of assault and battery and one count each of assault on a female, common law robbery, larceny of a firearm and resisting a public officer.
                On the evening of Friday, Dec. 13, Kimbrell and another man, 32-year-old Paul Edward Poteat, address listed as Copper Pot Road in Marion, went to the home of Marvin Branch II on U.S. 70 East in Nebo and were allowed inside the house.
                The two suspects pepper sprayed Branch; Branch’s brother, Austin Chivers; and a woman in the house, Aserria Burgess.
                The pair then stole a gun and fled.
                Poteat was previously arrested. Kimbrell was on the run from investigators with the McDowell County Sheriff’s Office.
                Deputies received information Wednesday afternoon that Kimbrell was near his home on Jacktown Road. When they arrived on the scene, the suspect fled on foot into the woods but was apprehended a short time later by Detective Robert Watson and Deputy T.J. Madden.
