NAME AND CLASSIFACATION OF CHARGES (F/M/V):
1. Unlawfully Dealing with a Child 1st Degree-A-Misdemeanor
ARRAIGNMENT/BAIL STATUS: Sepulveda and Gumuka were issued appearance tickets returnable to Amsterdam City Court at a later date. Martinez-Ayala was held pending arraignment on three bench warrants as well as an additional charge of Criminal Possession of a Controlled Substance 7th Degree-A-Misdemeanor stemming from contraband found on his person incident to arrest.
INCIDENT NARRATIVE: On Friday September 27th the Amsterdam Police Department, Montgomery County Sheriff’s Office, and the New York State Liquor Authority conducted an underage alcohol sting in the City of Amsterdam and the surrounding parts of Montgomery County at various points of sale of alcoholic beverages. These range from supermarkets and gas stations as well as bars and restaurants.
Found to be non-compliant by selling alcohol to a person under the age of 21 years old was 28 year-old Jorge A. Sepulveda of Amsterdam while working as a clerk at West End Wine and Liquor as well as 55 year-old Raymond G. Gumuka of Amsterdam while working as a bartender at Girard’s Bar located in the City of Amsterdam. A third person 33 year-old Hector A. Martinez-Ayala of Amsterdam was also charged. Martinez-Ayala was not working in any formal capacity for any point of sale though it was observed by police that he purchased an alcoholic beverage and did give it to a person under the age of 21 years.
Martinez-Ayala was also known to be wanted on three separate bench warrants for non-appearance in Amsterdam City Court. Martinez-Ayala was taken into custody and a search of his person revealed him to be in possession of a small amount of a controlled substance. Martinez-Ayala was held overnight at Amsterdam Police Headquarters for arraignment the next morning in Amsterdam City Court.
