Aggravated Battery of a Peace Officer/Domestic Battery

9/14 – 11:05 p.m. – Police were dispatched to a domestic disturbance call on East Oak Street. The disturbance was between a male and female who reside together. A Smithton Officer responded for backup. When the Officers attempted to arrest the male suspect he struck the Smithton Officer in the face with his fist. During the altercation the Millstadt Officer was struck in the head, causing part of a tooth to be knocked out. The suspect was eventually placed into custody. On the 16th the St. Clair County State’s Attorney’s Office charged the suspect, Steven T. Derryberry, age 37 of Millstadt with the following:

Count 1: Aggravated Battery of a Peace Officer: in that the said defendant, in committing a battery, knowingly made physical contact of an insulting or provoking nature with the Millstadt Officer, in that he struck the Officer in the head, knowing him to be a peace officer engaged in the performance of his authorized duties; A Class 2 Criminal Felony, Category A Offense.

Count 2: Aggravated Battery of a Peace Officer: in that the said defendant, in committing a battery, knowingly made physical contact of an insulting or provoking nature with the Smithton Officer, in that he struck the Officer in the face with a closed fist, knowing him to be a peace officer engaged in the performance of his authorized duties; Class 2 Criminal Felony, Category A Offense.

Count 3: Domestic Battery: in that the said defendant, knowingly made physical contact of an insulting or provoking nature with the victim, a family or household member of the defendant, in that he pushed her head into a wall, causing her to fall to the ground. A Class A Misdemeanor, Category A Offense.

His bond was set at $60,000.
