Update to Shooting Investigation

The ECPD has made an arrest based on the investigation of the shooting incident, which occurred on August 25, 2019 at 2158 hours.
Thomas Vincent Whalen, a transient male, 44 years of age, has been arrested for Assault with a Deadly Weapon or instrument, other than a firearm upon a peace officer, a violation of California Penal Code Section 245 (c). The bail is $75,000. The booking photo of Mr. Whalen is attached to this notification.
The arrest was made based on evidence that he used a rock as a weapon during an assault of an off-duty police officer. The officer [employed by the San Francisco Police Department] subsequently shot Mr. Whalen.
The matter is still under active investigation. El Cerrito PD Detectives and Senior Inspectors from the Office of the District Attorney are still following up on leads and evaluating evidence.
The ECPD was unable to locate anyone who saw the event. If unidentified witnesses exist, they are asked to contact the ECPD Detective Unit to assist with the investigation.
Mr. Whalen remains in stable condition at the hospital.
