Assault Investigation Update

The Ontario Police Department has concluded its investigation into the assault that occurred at Waba Grill on December 12, 2018.  The investigation involved a review of in-store video and interviews with witnesses and all involved parties.  We are confident that a thorough and complete investigation has been conducted and have been in contact with the San Bernardino County District Attorney's Office who will review the case at the start of the week.

Based on information gained throughout the investigation and a review of all applicable legal statutes, the Ontario Police Department will present the case to the DA as a Battery.  The crime of Battery, in this instance, is a misdemeanor which requires the filing of formal charges from the District Attorney before an arrest can be made.  An arrest outside of this legal process would be unlawful.

The Ontario Police Department recognizes the sensitivity of some of the allegations surrounding this case, namely those which allege racial motivation.  Each of these considerations will be brought to the attention of the District Attorney to ensure the appropriate charge is sought.

The City of Ontario is a respectful and diverse community, and we appreciate the public's patience as we take careful steps to ensure the case is processed appropriately.

This is an on-going investigation, and anyone with information is asked to call the Ontario Police Department at 909-986-6711 or Detective Josh Burks at 909-408-1912.

Information can also be reported anonymously by calling WE-TIP at (800) 78-CRIME or online at www.wetip.com.
