PRESS RELEASE: Assault with a Deadly Weapon/Suspect in-custody. SRPD case #18-16476

On December 11, 2018 at about 7:30 p.m., Santa Rosa Police Department received several calls of a male subject attacking another subject with a shovel in the parking lot of Popeyes Restaurant on Stony Point Road at Sebastopol Road. Another reporting party stated there was a knife involved and one of the subjects may have been stabbed. Callers described the suspect as an intoxicated, large Hispanic male who attacked a black male with a knife. Due to multiple citizens calling in to report this incident, there were conflicting reports about what occurred.

After arriving on scene, the suspect, later identified as 36-year-old Steven Silva, was contacted by officers walking away from the scene, on Stony Point Road at Rose Avenue. Silva had a laceration above his eye and appeared to be intoxicated. Silva refused medical attention after an ambulance was called to the scene for his injury.

The 53-yedar-old victim of the assault was contacted at the scene and told officers Silva attacked him after he denied Silva’s request to borrow his bicycle. After the victim denied his request, Silva became angry and began stomping on the victim’s bike. The victim confronted Silva and tried to intervene when he was physically attacked and taken to the ground. As the victim tried to retreat, Silva grabbed a near-by handle from a broken shovel from outside the restaurant and began swinging the large piece of wood, hitting the victim at least once. As the victim tried to retreat, Silva pulled a sharp tool out of his pocket and attempted to stab the victim during the altercation. The tool was later discovered to be a box cutter.

The victim said he grabbed the shovel handle from Silva at one point during the altercation, and hit Silva in self-defense, causing the laceration above Silva’s eye. Silva was found to be responsible for starting the altercation after officers conducted their investigation and gathered witness statements.

The victim had moderate swelling and redness to his left arm and the back of his head from being struck by the suspect. The victim was not cut or stabbed by the suspect during the altercation with the box cutter and was medically treated at the scene.

Silva was booked at the Sonoma County Jail on two counts of 245(a) (1) PC, Assault with a Deadly Weapon. Silva told officers on scene that he is homeless and stays in Santa Rosa.
