INCIDENT: PC 422 Criminal Threats, PC 459 Burglary, PC 594 Felony Vandalism, PC 246.3 Negligent Discharge of a Firearm, PC 30605 Possession of an Assault Weapon, PC 32310 Possession of High Capacity Magazine

LOCATION: 2090 block of Mallory Street, Muscoy

SUSPECT(S): Anthony Arias, a 25-year-old resident of Muscoy, Rogelio Arias, a 21-year-old resident of Muscoy

VICTIM(S): Confidential


SUMMARY: On Sunday, September 30th, at approximately 1:27 am, deputies from Central Station responded to the 2090 block of Mallory Street, in the City of Muscoy, reference subject's trying to force their way into a residence. While deputies responded, the victim advised the suspects fired a gun just outside his home. Upon arrival deputies located Anthony Arias hiding behind a vehicle in the front yard of the location. Deputies found an AK-47 with a high capacity magazine near where Anthony was hiding. A round was in the chamber, and 19 more were in the magazine.

Following the investigation, deputies determined that the incident location consists of three dwellings all located on the property, the victims live in one. Anthony and his brother Rogelio live in another residence. Anthony was involved in an argument with Victim #1. Anthony and Rogelio challenged the victim to a fight. The victim was in fear and retreated into his residence. Anthony and Rogelio began breaking the windows on the victim's four parked vehicles on the property. A total of 16 windows were shattered on the vehicles. When the victim did not come outside to fight, Anthony and Rogelio attempted to force their way into victims' residence. They continued to yell and scream at the victim trying to get him to come outside and fight. The victim then heard gunfire outside of the residence. Deputies found one spent shell casing located in the driveway. The shell casing was the same make and caliber found in the AK-47. Deputies could not find anyone injured or property damage as a result of the negligent discharge of the firearm.

Anothony and Rogelio were subsequently arrested and booked into Central Detention Center, in lieu of $125,000 bail.
