OSBI Special Agents Arrest Newcastle Man for Killing His Father

Friday evening, OSBI special agents arrested a Newcastle man for killing his father. The victim, 40-year-old Timothy Brooks, died of a gunshot wound to his abdomen in August 2012. James Kyle Brooks called police from his father’s Marlow home reporting the shooting as a suicide. Marlow police detectives and investigators with the local district attorney’s task force conducted interviews and collected evidence. The medical examiner stated that although he believed it was highly unlikely Timothy Brooks shot himself with the shotgun, he did believe it was possible. The case went cold for several years until the Marlow Police Department requested an OSBI special agent review the facts. The OSBI agent immediately began finding discrepancies in the son’s story about how his father shot himself. The agent discovered Kyle Brooks (6/13/1980) had taken out a $500,000 life insurance policy on his father. The policy had a two-year suicide clause, meaning if the person killed himself within that two-year timeframe the policy would not pay out. The shooting happened two years and six months after the policy was issued. Kyle also could not explain how the shotgun had recycled after the trigger was pulled. He also claimed his father was cleaning the 12-gauge shotgun prior to the shooting. Officers and detectives at the scene noted the absence of any cleaning materials or cleaning solvent odor. Kyle Brooks now sits in the McClain County jail on one count of murder in the first degree with deliberate intent. He will be transported to the Stephens County jail to await court proceedings.
