On 2/18/2018 at 02:46 AM Janesville Police Department Patrol units responded to a shots fired incident in the 100 Block of S Locust St. Evidence of injury was found in the area, and witnesses were contacted. The area was secured for evidence processing. At the same time, David Toles was found at Mercy Hospital with a non-life threatening gunshot wound to his leg. Janesville Police Department Detectives and Street Crimes Unit Officers were called in to help Patrol investigate.
The investigation revealed brothers David Toles and John Toles got into a verbal and physical altercation, which ended in the 100 block of S Locust St when David Toles went into his residence at 103 S Locust St and got a handgun. David Toles took the handgun outside. David Toles pointed the handgun at John Toles and a physical altercation ensued. During the altercation, there were three to four rounds shot, and John Toles ended up taking the gun away from David Toles. One of the rounds struck David Toles in the leg during the physical altercation over the gun.
The gun has been located and seized. All parties involved have been located. David Tolles and John Tolles were arrested and held at the Rock County Jail on charges.
