CASE OF THE WEEK - Physical Assault Suspect Apprehended

On June 22, 2017, two adults were involved in a physical argument in their Santa Clara home. A neighbor called Public Safety Dispatchers after hearing banging and screaming. The individuals have been in a dating relationship for approximately two years, live together and do not have any children in common. The victim’s two children were present during the assault.

During the fight, the victim was physically assaulted and sustained serious injuries. Victim #2, a juvenile, pulled the suspect off victim #1. Victim #2 was assaulted and sustained minor injuries before the intoxicated suspect fled the house. The Santa Clara Fire Department provided both victims with aid before being transported to a local hospital for treatment. Officers completed the required domestic violence paperwork and obtained an Emergency Protective Restraining Order for the victim. A Records check on the suspect revealed he had two outstanding warrants out of Indiana, one is an outstanding extraditable felony warrant.

On June 26, 2017, the suspect contacted the victim’s children and threatened to go to the house and kill everyone.

On June 27, 2017, the Special Enforcement Team (SET) Detectives were in the area of McKinley Drive and Michael Way in San Jose looking for the suspect. Detectives approached the suspect, who was among another male subject. He identified himself with several false names. Eventually, he admitted his true identity. The other subject was identified and released. The suspect was taken into custody and transported to the Santa Clara County Jail (Case Number # 17-5360).

During the investigation, Detectives learned the suspect threw a cinder block garden paver on the victim’s car on May 22, 2017, causing damage to the victim’s car and an adjacent vehicle. This incident was reported to police (Case Number #17-4479), however a similar vandalism incident in April, 2017, was not reported to police.

It can include physical violence, sexual violence, psychological violence and emotional abuse. The frequency and severity of domestic violence can vary dramatically, however, the one constant component of domestic violence is one partner’s consistent efforts to maintain power and control over the other.

Domestic violence can result in physical injury, psychological trauma, and in severe cases, even death. The devastating physical, emotional, and psychological consequences of domestic violence can cross generations and last a lifetime.
