Incident:  25 year old Petaluma resident arrested for DUI after being refused the sale of alcohol at two Petaluma Businesses.

Summary:
On January 3, 2017 at 1:38 PM Petaluma Police Department Dispatch received a call from an employee at Lucky’s located at 1000 Petaluma Blvd. North that two white males in their twenties were attempting to buy alcohol and appeared to be intoxicated. Lucky’s refused them the sale of alcohol they were trying to purchase and then saw the two get into a Chevrolet Pickup with an associated license plate and called the Petaluma Police Department to report a possible DUI driver.

Officers checked the area and were unable to locate the pickup. At 1:50 PM Petaluma Police Dispatch received another call regarding the two males with the same pickup attempting to buy alcohol this time at BevMo located at the East Washington Place Shopping Center. Employees refused the two males the sale of alcohol and observed them get into the Chevrolet pickup and then called police. Both Lucky’s employees and BevMo Employees described the two as smelling of alcohol and having slurred speech.

An officer located the Chevrolet pickup on Magnolia Ave. near Petaluma Blvd. North and stopped the vehicle. The driver was identified as 25 year old Vincent McCarthy a Petaluma resident. McCarthy had objective signs of intoxication and was evaluated for DUI. He performed poorly on field sobriety tests and was subsequently arrested for DUI. McCarthy performed a breath test at the Petaluma Police Station and the test revealed his blood alcohol level was .19 BAC. Over twice the legal limit of .08 to drive in California.

McCarthy was released to a responsible party with a citation to appear for DUI and driving with a blood alcohol level above .08.
