OAK RIDGE NORTH POLICE CRIME ACTIVITY REPORT


While on patrol at approximately 0037 hours on 07-16-2010, Precinct 3 Deputy Constable Moody, Unit #8319, was attempting to stop a tan Ford Explorer on Hanna Road at Cox and the vehicle was refusing to stop. MCSO dispatched asked for any Unit to assist. I notified MCSO dispatch that I would be en route to his location to assist. Deputy Moody stated the vehicle was going toward the apartments on Brookhaven. Before I arrived in the area, I could hear Deputy Moody calling out streets in the area just around the apartment complex. I arrived in the area travelling northbound on Brookhaven and the suspect vehicle was southbound on Brookhaven approaching head on. The suspect vehicle then turned eastbound on Rayford Forest, then south on Oakhurst toward Rayford. Suspect vehicle then turned west on Rayford toward the IH-45 North east service road. Suspect vehicle went north on the IH-45 North east service road and turned east onto Rayford Forest. Suspect vehicle then turned south on Brookhaven and turned east into a parking lot. As soon as I pulled onto Rayford Forest, Deputy Moody called out that the driver of the vehicle was running on foot wearing green. I then observed a male, approximately 6'00 tall, wearing a dark green tee shirt (no sleeves), light green shorts, and white shoes running northbound from Deputy Moody's location. I pulled my patrol Unit into the parking lot north of Rayford Forest and gave chase. The suspect was running in and out (zig zag) between buildings. I caught up to the suspect as he reached the parking lot south of Raypine. I gave verbal commands for the suspect to get on the ground and show me his hands. Suspect continued to refuse any of my commands so I deployed my department issued Taser (X00-499438) and suspect started to run westbound toward and I fired my taser (cartridge #T-07 1356651) missing the suspect as he ducked down next to a parked vehicle. I then ran up in front of suspect to drive stun him with me taser and he slapped my Taser hand and punched me in the chest to run southbound. When suspect started to run I tripped him that caused him to fall. Before suspect could get to his feet, I attempted to gain control of his right wrist. The suspect then became combative punching and kicking me, in attempt to free himself. At this time several other deputies arrived and handcuffed the suspect. I received several minor cuts to my forearms and head during the arrest. The suspect was then transported back to original scene. I went back in service and notified Sgt Libby at shift change.


On 07-16-10 at approx. 1536 hours I, Officer McGrew, on patrol at the IH 45 WFR and Woodlands Pkwy NW LP. I observed a silver Pontiac Grand Am, bearing a temp. LA LP #13535643, traveling S/B on the IH 45 WFR behind me. Upon making contact with the vehicle, I advised the driver of the reason for the stop and requested his DL. The driver identified himself as Travone Johnson, TX ID #XXXXXXXX. I asked Johnson if he had a valid DL and he advised that he did not. I was unable to locate a valid DL for Johnson on my MDT. Johnson also advised that he did not have liability insurance on the vehicle because he could not afford it. I observed that Johnson appeared to be very nervous. I observed that his hands were shaking as he handed me his ID card. Due to Johnson being uninsured and unlicensed, I advised MCSO dispatch to start an Oak Ridge North wrecker call for the vehicle per ORNPD S.O.P. I then asked Johnson if there was anything in the vehicle that he should not have. Johnson advised that there was not. I then conducted an inventory of the vehicle. While inventorying the vehicle, I found a large, clear, plastic bag that contained a large amount of a green leafy substance that I know to be marijuana from my training and experience. I observed that the large plastic bag contained a total of 20 individually packaged smaller bags of marijuana commonly used for redistribution. I observed that the marijuana was located on the front passenger side floorboard under a white shirt. Due to Johnson being in possession of marijuana, I placed him in custody for possession of marijuana. I then read Johnson the Miranda warning in view of my patrol vehicle camera. Johnson then advised that he sells marijuana to make extra money. Johnson advised that he had just purchased the marijuana for approx. $145. He stated that he sells marijuana at Olive Garden (his employment). Johnson stated that he knew that he did wrong and that he had not been honest with me. Johnson made these statements in view of my patrol vehicle camera. Johnson was cited for expired MVI, failure to obtain a DL, and failure to maintain financial responsibility. He was issued a warning for failure to drive in a single lane. Johnson's vehicle was towed by Township Towing to 6317 Big Oak, Conroe, TX. The marijuana was weighed on an OHaus scale and showed to weigh 3.57 grams. Due to the weight of marijuana Johnson was charged with possession of marijuana (2 ounces to 4 ounces). He was then transported to MCSO jail in The Woodlands, TX. This incident was recorded on Unit 75's digital camera system. The marijuana was placed in ORNPD evidence.

On 07-16-10 at approx 1854 Hrs I, Officer McGrew, was on patrol in the 27800 block of IH 45 EFR. I was waved down by a W/M driving a white BMW 4 Dr. The W/M identified himself as Christopher Seagler, TX DL #XXXXXXX. Seagler advised that a W/M driving a silver SUV had been following him for some time. Seagler then stated that the W/M had just pulled into the same parking lot (just west of Pancho's Mexican Restaurant front door in the parking lot). The W/M then pointed to the silver SUV and advised, "That is him right there." I advised Seagler to stay where he was. I then drove over to the silver SUV. I observed the W/M driver exit the silver SUV, look my direction, and then walk to the rear of his vehicle. I advised the W/M to approach my vehicle and wait at the front of my patrol vehicle via my patrol vehicle PA system. The W/M then attempted to go to my driver's side window. I advised the W/M again to wait at the front of my patrol vehicle. I then observed a W/F exit a vehicle, just to the left (towards Pancho's) of the actor's vehicle (silver SUV). The W/F then started to approach my patrol vehicle. I advised the W/F to return to her vehicle via my patrol vehicle PA system. The W/M female advised that she was deaf and motioned to her ear. In a seated position, never leaving my patrol vehicle, I motioned for the W/F to return to her vehicle by waving my hand in the direction of her vehicle and she complied. A second W/F, later identified as Valeria Howell, started to approach my patrol vehicle from another vehicle ( not the actor's). I advised that W/F to return to her vehicle. Valeria Howell became argumentative asking, "What is going on?" I advised her that I did not know and that was what I was attempting to find out. The W/F continued to approach my patrol vehicle. I advised her a second and third to time to return to her vehicle. Valeria Howell continued to argue but returned to her vehicle. She then began to record me with her cell phone stating, "I'm recording this!" Valeria Howell then stated, "I would like some professional courtesy." I asked Valeria Howell what she meant. Valeria Howell (the actor's wife) then stated that she was a director at a hospital and treats Police Officer's all the time when they need help so she would like some professional courtesy in reference to this incident. I advised Valeria Howell that I would treat everyone equally. I then advised Howell to please wait by her vehicle so I could finish investigating the incident.
I then made contact with the actor, later identified as Gaylin Howell, TX DL #XXXXXXXX. I asked Howell what was going on. Howell advised that the W/M in the white BMW, had been following him for some time. Howell advised that when he entered the restaurant parking lot, he made contact with his wife and advised her to stay in the vehicle. At this time Howell was very agitated and yelling. I advised Howell several times to lower his voice and calm down. I then asked Howell, "Why didn't you contact the Police if you thought that he was following you?" Howell advised that he thought that the vehicle had left until he observed him in the parking lot talking with me. I asked Howell if he had been involved in a "road rage" type incident with Seagler and he advised that he had not. He again advised that he thought that Seagler was following him and observed Seagler run through red lights near the Woodlands Mall. I then made contact with Seagler. I asked Seagler to tell me what had taken place. Seagler advised that Howell had been following him for some time. Seagler advised that as he attempted to get away from Howell, he observed Howell still following him at speeds of 90 MPH and riding his bumper. Seagler advised that he observed his vehicle then start to pull to the right. He pulled his vehicle over in a cud a sac, thinking that he may have a flat tire. As he was checking the tire he observed the silver SUV in the distance. He stated that the SUV was now stopped, and observed Howell looking in his direction from the vehicle. Seagler advised that he thought that Howell was a private investigator. He stated that he had some trouble with an ex girlfriend and figured that was what it was about.
After speaking with both Seagler and Howell it appeared that no offense had taken place. I then released both Howell and Seagler.
