Open burning of firewood is now allowed in properly controlled and tended fire pits.

Effective Immediately,

On September 28, 2009, the Village Board revised the Open Burning Ordinance. Open burning of firewood is now allowed in properly controlled and tended fire pits. These pits must be operated in a safe manner, tended at all times, and not otherwise constituting a nuisance. Below is the actual revised ordinance:

Village Code Amended. Section 5-1 (“Nuisances Enumerated”) of Article I of Chapter 5 (“Health and Sanitation”) of the Justice Municipal Code is hereby amended by adding the following, subsection (c) to the end thereof, to read as follows: (c) Subject to the provisions of Section (a)(1),(22),(29),(36) and (44-46) hereof, and notwithstanding anything to the contrary contained in Sections 5-1(a)(33), 5-222(d) or elsewhere in this Code, “open burning” of firewood within properly controlled and tended backyard “fire pits,” and/or the operation of commercially available “fire pits” utilizing a controlled and self-contained fuel source as reasonably intended for backyard use, shall be permitted within the confines of the Village, conditioned upon such “fire pits” being (1) operated in a safe manner, (2) tended at all times, and (3) not otherwise constituting a nuisance.
