Renewed and modified the First Revised Mayoral Declaration of Local State of Disaster due to a Public Health Emergency COVID-19

Last night, March 30, 2020, the Farmersville City Council adopted an ordinance that renewed and modified the First Revised Mayoral Declaration of Local State of Disaster due to a Public Health Emergency in response to the COVID-19 Virus outbreak (the “Ordinance”). This Ordinance issues a “Work-At-Home” order with specific limits and exceptions as it relates to the following:

providing City Services; limitations on gatherings with an exception for certain City of Farmersville meetings; restrictions on dine-in services; the closure of bars, indoor recreation facilities, and public venues; funerals; the impact on the entire household of a household member testing positive for COVID-19; limitations on visiting nursing homes, retirement, and long-term care facilities; closure of public and private schools; and, a mandate to stay home when sick.

The exceptions to the Work-At-Home order in this this Ordinance adopts the direction issued by the President of the United States through his March 16, 2020 Declaration, that persons who work in “critical infrastructure industry” have a special responsibility to maintain their normal work schedules. In response to the President’s Declaration, the National Cybersecurity and Infrastructure Agency (“CISA”) has identified a list of “Essential Critical Infrastructure Workers” (“List”) to help state and local officials protect their communities while ensuring continuity of functions critical to public health and safety as well as economic and national security. This List, which is set out at length in the Ordinance, identifies the categories of workers and types of work to be performed that are encouraged to continue their usual work routines provided that those persons also comply with the limitations necessary to avoid the spread of COVID-19 specifically including, but not limited to, social distancing.
