Federal judge grants motion for summary judgment in favor of San Bernardino County and Deputy Paul Casas

FEDERAL JUDGE GRANTS MOTION FOR SUMMARY JUDGMENT IN FAVOR OF SAN BERNARDINO COUNTY AND DEPUTY PAUL CASAS


On June 15, 2017, Tyrone Johnson was contacted by Deputy Paul Casas during a traffic stop, in the City of Grand Terrace. Upon contact with Johnson, Casas smelled marijuana emitting from inside of the vehicle and observed a four-month old child in the rear seat. During the investigation, Johnson fled on foot leaving his minor child in the vehicle. Casas pursued Johnson and a use of force occurred at the time of arrest. Johnson was booked into jail for possession of narcotics for sale and child endangerment.

Johnson was convicted of possession of controlled substances for sale and resisting arrest. After his conviction, Johnson hired attorneys Brian Dunn and Megan Gyongyos who filed a lawsuit against San Bernardino County and Deputy Paul Casas alleging civil rights violations, battery, and negligence. On January 16, 2020, United States District Judge Dolly Gee granted a motion for summary judgement in favor of San Bernardino County and Deputy Paul Casas, and against Tyrone Johnson. Attorney Dennis Wagner of Wagner Zemming Christensen, LLP represented San Bernardino County and Deputy Paul Casas.
