State law allows for fireworks up until 1:00 AM on New Years Day. State law supersedes the local noise ordinance.
Yes, even if it is keeping you awake, frightening your pets, etc, it's legal. There's nothing that we can legally do to stop people from doing it.
Each New Years and July 4th we send out this with a reminder that the noise ordinance is only in effect from 11:00 PM to 7:00 AM; so, if you insist on exercising your legal option to annoy your neighbors with fireworks until 1:00 AM, don't get upset if they wake you up at 7:00 AM making perfectly legal noise of their own.
