- 187 PC – Murder;
- 23153(g) CVC – DUI causing death (prior conviction);
- 11377(a) H&S – Possession of a Controlled Substance
- Probation Violation (DUI)
VICTIM: 6-year old male juvenile
SUSPECT: Franky Provencio, 19 years of age, from Pomona, Ca.
SUSPECT VEHICLE: Blue 2001 GMC Yukon

On Tuesday May 7th, 2019 at about 4:24 PM, a Pomona Police Officer witnessed a serious traffic collision in the area of the 2200 block of N. White Ave. LA County Fire personnel responded to assist. Unfortunately, a child in one of the vehicles was pronounced deceased at the scene.
The Pomona Police Department’s Major Accident Investigation Team (MAIT) was called to investigate. MAIT learned the suspect vehicle was travelling north on White Ave when, for unknown reasons, it crossed into opposing lanes of traffic on N. White Ave. It collided head on with another vehicle travelling south on N. White Ave.
The driver of the southbound vehicle, Peter George of Upland, is in critical condition at a local hospital. A 6 year old boy in the same vehicle received fatal injuries during the collision. The child was not properly secured in a child seat.
The driver of the suspect vehicle, Suspect Provencio, and his passenger, sustained injuries and were taken to a local hospital for treatment. The suspect was admitted to the hospital. The passenger was treated and released.
Assisting Patrol Officers were able to determine that Suspect Provencio was under the influence of alcohol and/or drugs. Their investigation also revealed the driver of the southbound vehicle had also consumed alcohol prior to the collision. His level of intoxication at the time of the collision is not yet known and MAIT Investigators are still following up.
MAIT investigators learned that Suspect Provencio was driving on a suspended driver’s license and was on probation for a 2018 DUI conviction. As part of his court proceedings, Suspect Provencio was warned of the dangers of driving while intoxicated (Watson Advisement). Because of this advisement and Suspect Provencio’s actions, he is eligible for to be charged with murder.
On May 9th, with the help of the DUI Training And Prosecution Section (DTAPS) of the Los Angeles County District Attorney’s Office, MAIT Investigators presented their case to the Los Angeles County District Attorneys Office. As a result, MAIT Investigators were able to obtain an arrest warrant for 187 PC – Murder, 23153(g) VC - DUI causing death (prior conviction), 11377(a) H&S – Possession of a Controlled Substance, and a Probation Violation.
DTAPS is a unit designed to assist law enforcement with the many issues associated with successfully prosecuting DUI-Drug cases.
When Suspect Provencio is released from the hospital, he will be booked at the Pomona Police Jail.

On Tuesday May 7th, 2019 at about 6:24 PM, Pomona Police Department received a call of a serious traffic collision in the area of White Ave, north of McKinley Ave. A Pomona Police Officer witnessed the head-on collision, which involved two vehicles. A child was located in the rear seat of one of the involved vehicles. Los Angeles County Fire Department pronounced the child deceased upon their arrival. Both invovled drivers are suspected of driving under the inluence of alcohol. The investigation is on-going.
