Incident Summary
 
Petaluma PD received reports of a driver who was passed out and suspected to be DUI in the drive-thru of Taco Bell.  Officers arrived and found the subject, identified as Abel Macedonio-Gutierrez, still parked in the drive-thru line.  He was uncooperative upon contact, refused to provide any information, and had to be removed, without force, from his vehicle. 
 
Once outside the vehicle, Macedonio-Gutierrez displayed signs of impairment, but denied drinking or using drugs prior to driving.  He continued to refuse to submit to any tests or attempts to evaluate him for the presence of alcohol and / or drugs despite officer’s exhaustive explanations of the potential consequences, including being released without charges if found to not be legally impaired.  He was eventually arrested for suspicion of DUI.  However, he then refused to submit an evidential chemical test per DMV requirement, causing officers to author a search warrant. 
 
A judge granted the warrant and a sample of Macedonio-Gutierrez’ blood was seized for chemical analysis.  He was then booked into the Sonoma County Jail and will face a one-year DMV suspension of his driving privilege for his refusal.
