Resources Available to Victims of Domestic Violence

In February, 2018, the victim contacted the Santa Clara Police Department. The victim separated from the suspect and they had a child in common. Since the break-up, the victim experienced increasingly violent acts from the suspect, including breaking and entering, assault, brandishing and kidnapping.
Detectives learned the suspect is prohibited from possessing a firearm. The suspect was the registered owner of a .357 caliber handgun. Due to the circumstances and sufficient evidence, SCPD detectives authored both an arrest and search warrant on the suspect and his fifth wheel travel trailer. A judge supported both actions and set the bail at $400,000.
Detectives located the suspect coming and going from an RV on Pala Avenue, in San Jose. During surveillance, the suspect got into a vehicle and began traveling in the direction of the victim’s residence in Santa Clara. A high risk car stop was initiated in the area of Lewis Street and Main Street utilizing both undercover detectives and uniformed police officers. The suspect was taken into custody without incident. A search of the suspect’s backpack, inside the vehicle, led to the discovery of two 9mm handguns, multiple loaded high capacity magazines (including a loaded 50-round drum magazine), a lock pick set, two knives, a black holster, black gloves and drug paraphernalia.
A search of the RV yielded one unloaded 9mm handgun, one unloaded bolt action World War II era rifle, one loaded 12 gauge shotgun, one loaded sawed off 12 gauge shotgun, one loaded .357 revolver handgun, one loaded .22 bolt action rifle, one loaded Mossberg shotgun, one loaded bolt action 30-06 caliber rifle, one loaded .410/.22LR caliber shotgun, hundreds of rounds of ammunition, a rifle case, a tactical vest, a police baton, a spotting scope and drug paraphernalia.
The suspect was transported to the Santa Clara County Jail. The victim was issued an Emergency Protective Restraining Order (EPRO) and domestic violence resources.
NOTE: Many victims of domestic violence try hard to manage the aggressor. Calls to police or survivor advocacy agencies often occur after the victim experiences more frequent, less disguised, more damaging and closer to lethal abuse over time.
