Effective Sept. 1st, 2017 it will be illegal in Texas to use a portable wireless communication device to read, write, or send an electronic message while operating a motor vehicle, unless the vehicle is stopped. The first offense is punishable by a fine between $25 and $99 with a subsequent offense carrying a fine of between $100 to $200. Exceptions include: using a portable wireless communication device in conjunction with a hands-free device, to navigate using a GPS or Navigation system, to report illegal activity, summon emergency help, to read a message that the person reasonably believed concerned and emergency.
