Trespassing Call Leads to Gun and Drug Charges

  On July 2, 2017 at approximately 4:59am, a security company contacted BPD to report a suspicious person and vehicle were possibly trespassing on a construction site they monitor on the 200 block of Tunnel Road, in Berkeley. When officers arrived on scene they found the suspect inside of the construction site standing atop of a portable office.

The suspect behaved erratically in the officers’ presence. The suspect admitted to officers that he had recently used cocaine, and that he had more of it on him. Officers searched him and found a bindle of powdery white substance which tested presumptive positive for methamphetamine.

During the search of the suspect’s trucks, a loaded and concealed firearm was recovered. A computer check of the gun’s serial number showed that the gun had been reported as stolen out of Louisiana in 2014. A records check of the suspect revealed that he was convicted of a felony on November 1, 2002, and was prohibited from possessing a firearm.

The suspect was identified as Luis Rojas 38, of Yuba City. Rojas was booked into the Berkeley City Jail for possession of a controlled substance, carrying a loaded firearm in public, possession of controlled substances while armed with a handgun, and possession of stolen property.
