At approximately 3:00 P.M. today (12/17/09) Newport News Police and agents of the U.S. Marshals Service arrested a 16 year old male, Newport News teenager and 19 year old Nahfis Nichols of Newport News. Both Nichols and the 16 year old were found in an apartment in the 100 block of America Drive in the Oyster Point East apartment complex. No one was injured during the arrest and police are now questioning both in the Jerome Houston homicide. The 16 year old, classified a danger to the community, is no longer a community threat.

The 16 year old is charged with Murder, Use of a Firearm in the Commission of a Felony and Possession of a Firearm by Felon. Active warrants for two (2) counts of Failure to Appear in Criminal Court and one (1) count of Failure to Appear for a past Possession of a Firearm by Felon were served on Nahfis Nichols, who is being questioned about his knowledge of this homicide.

Newport News Police and the Marshal Service located the pair by following leads provided by the community and employing trusted investigative techniques. The investigation is on going.

UPDATE: Under normal circumstances, law enforcement in Virginia is forbidden by state code from identifying juvenile suspects without a court order. Because of the nature of this case, investigators contacted the Commonwealth’s Attorney asking to have a court order issued to allow the release of this suspect’s identity and photograph to assist in his apprehension. Now that he has been taken into custody, the Police Department must revert back to identifying him by age, gender and city of residence only. However, should he be certified to stand trial as an adult, we will then be able to identify him by name. This in no way prevents the media from indentifying the suspect by name ay anytime.
