5/7/16, press release - Simple Assault/Reckless Endangerment/Aggravated Disorderly Conduct

On 07 May 2016 at approximately 2253 hours, the Burlington Police Department received calls reporting a man, later identified as Mr. Torrey Allard had pointed a firearm at a male later identified as Mr. Scott Hatin while in traffic at the intersection of S. Winooski Avenue and Pearl Street.

Allard reportedly threatened and pointed a firearm at Hatin after Hatin exited his vehicle to confront Allard about items being throwing at his car. Initial reports indicated that this incident evolved from a verbal altercation concerning motor vehicle operation between Allard and Hatin.

As a result of information obtained from Hatin as well as another witness, Burlington Police Officers located Allard and his vehicle in the parking lot of Simon’s Mobil located on Park Street. Allard was detained and Officers recovered a Colt Commander CO2 BB gun from Allard’s vehicle. The Umarex Colt Commander CO2 BB gun is a replica of an actual Colt Commander 1911 firearm.

As a result of this incident, Mr. Allard was lodged at Chittenden Regional Correctional Facility in South Burlington on $1000 bail for the crimes of simple assault, reckless endangerment and aggravated disorderly conduct.

Title 13 § 1023- Simple assault: A person who is convicted of simple assault shall be imprisoned for not more than one year or fined not more than $1,000.00, or both.

Title 13 § 1025- Recklessly endangering another person: A person who recklessly engages in conduct which places or may place another person in danger of death or serious bodily injury shall be imprisoned for not more than one year or fined not more than $1,000.00 or both.

Title 13 § 1026a- Aggravated disorderly conduct: A person who is convicted of aggravated disorderly conduct shall be imprisoned not more than 180 days or fined not more than $2,000.00, or both.
