New law requiring all drivers to stop at intersections that have experienced a power failure goes into effect

With the potential of uncertain spring weather quickly approaching us, drivers are reminded of the possibility that power outages can cause traffic control signals to go dark at intersections. These intersections can be very dangerous as many drivers treat this as a “freebie” and feel like they don’t have to stop.

During the 2015 Legislative session, state statute 346.37 was amended as follows; “ If a traffic control signal suffers a loss of power or otherwise malfunctions so that the traffic control signal does not exhibit any color of light, vehicular traffic, pedestrians, and persons riding bicycles or electric personal assistive mobility devices shall proceed at the traffic control signal as if the traffic control signal were an official stop sign.”

When power is lost at a controlled intersection, drivers should consider these intersections as a 4- way stop, and proceed cautiously when it is safe to do so, while adhering to normal right-of-rules.
