On December 14, 2015 at approximately 7:00 P.M. the Gilroy Police Department’s Communications center received a call regarding a domestic violence disturbance. The caller reported that a woman was hiding from a male who was believed to be her boyfriend. The caller also believed the suspect found her and added that the woman was being pulled by her hair, and being grabbed and he thought the suspect was threatening her.
Gilroy Police Officers immediately responded to the scene. From the time the first officer was dispatched to the time he arrived, approximately 4 minutes had elapsed. Once the first officer arrived on the scene he could hear the disturbance. The officer assumed a position where he could listen and observe what was happening. Within 90 seconds of arriving and while he was waiting for back up officers, the officer was confronted by the suspect who charged at the officer. Based on the suspect’s actions and the information the officer was given regarding the domestic violence disturbance and all other circumstances considered the officer believed he was facing a lethal encounter and fired his weapon.
The officers began to provide medical assistance to the suspect until emergency medical professionals arrived. The EMS personnel assisted with the lifesaving efforts to no avail. The suspect succumbed to his injuries and was pronounced deceased at the scene. The Officer, who is a four year veteran of law enforcement, did not suffer any physical injuries.
Gilroy Police Officers are issued body worn cameras. As part of the ongoing investigation we will review any audio and/or video recordings of this incident.
In accordance with the department’s policy, the officer has been placed on routine administrative leave.
This case is being investigated by the Gilroy Police Department Detective Bureau. Consistent with Santa Clara County protocol, the District Attorney’s Office was present for interviews and is monitoring the investigation. The County Medical Examiner’s office is responsible for releasing any information regarding the identity of the suspect
Once the investigation is complete, the case will be presented to the District Attorney for review. They will determine what if any action will follow.
