Incident Summary

On Dec. 9, 2015 at 9:21 PM Petaluma Officer Brenden Sawyer was stopped at the intersection of Petaluma Blvd. North and Washington St. He observed A silver 2001 Chrysler PT Cruiser turn left onto East Washington St. from Petaluma Blvd. North and drive the wrong way and on the wrong side of the concrete barrier which separates W/B and E/B traffic. As Officer Sawyer positioned himself to make a traffic stop he saw the driver of the Chrysler drive E/B on the W/B side of the roadway then make a quick turn thru an opening in the concrete barrier which is meant for left turns allowing him to get into the correct direction of travel. After getting onto the right side of the roadway the driver of the Chrysler accelerated quickly to approx. 40 MPH (Posted Speed Limit is 25 MPH) before Officer Sawyer was able to stop the vehicle.

Officer Sawyer stopped the Chrysler in the parking lot of the CVS Store on East Washington St. He contacted the driver of the vehicle and identified him as Daniel Marquez a 36 year old male from Sebastopol. Also in the vehicle were Marquez three daughters who are 16, 11 and 9 years old. There were also numerous empty beer cans in the back passenger area of the vehicle. Marquez had signs of possibly being under the influence of alcohol and was examined for impairment.

After performing poorly on FST’s he was placed under arrest for Driving Under the Influence of Alcohol. He was also charged with child endangerment for operating a motor vehicle with his three underage children in the vehicle while being under the influence of alcohol. It was also learned that Marquez does not have a driver’s license.

Marquez performed a breath test and the results showed his blood alcohol level to be .20 BAC. which is one and a half times the legal limit in California. Marquez is also on probation for a prior driving without a license offense and for being under the influence of a controlled substance.

Marquez was booked into the Sonoma County Jail for driving under the influence of alcohol, driving with a blood alcohol level of above .08 BAC., driving without a valid driver’s license, child endangerment and violation of probation. His bail was set at $32,000.

The three children were released to their mother who responded to the scene to get them.
