Muncie Man Arrested for OWI Felony With A Child In The Car

Muncie – A Muncie man was arrested early yesterday evening for Operating While Intoxicated Felony after a trooper clocked him speeding on the Muncie Bypass.  Trooper Ryan Davis was traveling north bound around 4:45 p.m. on the Muncie Bypass, (U.S.35,) in the area north of Memorial Drive, when he saw a south bound vehicle traveling at a high rate of speed.

Trooper Davis got a radar clock on the vehicle of 89 M.P.H. in the 55 M.P.H. zone.  Davis turned and gave chase as the vehicle exited off the Bypass onto Memorial Drive.   The vehicle turned west finally pulling over into the lot of a bar and grill. When Trooper Davis made contact with the driver, David Kennedy, age 32 of Muncie, he noticed a child in the front passenger seat under 10 years of age.

Further investigation revealed that Kennedy was operating his vehicle as a Habitual Traffic Violator, with his license being suspended. It was further determined that Kennedy was Operating while Intoxicated, with a B.A.C. level over the .08% legal limit.

Kennedy was arrested and charged with Operating as a Habitual Traffic Violator, Level 6 Felony; Operating While Intoxicated with a prior conviction within 5 years, Level 6 Felony and Operating While Intoxicated Endangering, with a Passenger under 18 Years of Age, Level 6 Felony.

In addition Kennedy was charged with Speeding, 89 M.P.H. in a 55 M.P.H. zone, and operating a vehicle with a False and Fictitious Registration, both traffic infractions. He was lodged in the Delaware County Jail. Mr. Kennedy’s son was released to family members.

The Indiana State Police remains committed to reducing the number of impaired driving crashes as well as all crashes. Motorists are encouraged to report suspected impaired drivers by calling 911. Give a vehicle description, location, and direction of travel. Never follow an impaired driver.
