HM juvenile arrested for evading/resisting connected to trespassing complaint at Avondale Elementary.

On 9-18-2015, at about 11:15 AM, an APD School Liaison officer at Austin Middle School was contacted by an employee at Avondale School.  The officer was advised that what appeared to be a high school age Hispanic male was playing basketball on the property and would not leave when asked.  The school had asked the man to leave because elementary age children were about to be outside for recess.  The officer was driving to the school to respond to the trespassing.  The assistant principal that had contacted the juvenile pointed out a shirtless HM, carrying a basketball, walking eastbound on Westgate.  The Liaison officer recognized the subject as a former student that he had interacted with on several occasions at a middle school but who was no longer registered at AISD.  The officer turned to stop the juvenile and issue a trespassing warning.  The juvenile appeared to recognize the officer, and ran north and west, running through what the Liaison officer estimated to be about 75 children on the school ground.  The officer was out on foot, pursuing the suspect, who was yelling “I didn’t do anything!”  The officer lost sight of the juvenile near 15th and Avondale.  Officers responded to search the area.  The Liaison officer located the suspect crouched beside a house within a fenced back yard in the 1100 block of Smiley.  When officers tried to handcuff the suspect, he started struggling with them, pulling away and attempting to reach into his pockets.  He was handcuffed and officers escorted him to a patrol car.  A HM came out of the home and approached, drawing the officer’s attention.  He at some point identified himself as the suspect’s brother.  He was in the roadway while they were trying to complete the arrest.  Officers asked the man, who appeared to be taking video, to step out of the roadway several times.  After multiple warnings to step out of the roadway, he was arrested for pedestrian in roadway.  He was booked into the Randall County Jail.  He was Isaiah Thomas Gutierrez WM 19.  The juvenile was placed in the Youth Center of the High Plains for evading arrest and resisting arrest.  His name cannot be released because he is a juvenile.
