On July 3, 2015 at approximately 10:00 AM the San Luis Obispo Police Department received a call of a man with gun, in the area of Ella and Henry. The suspect, later identified as Dustin Maloney, was seen removing a gun from his pants and placing it in a trash bag. Officers in the area located Maloney, based on the description provided by the reporting party. As officers attempted to contact Maloney, he ran from the location towards 1901 Henry. Officers pursued Maloney into the apartment complex but lost sight of him during the foot pursuit. A perimeter was quickly established around the apartment complex as officers searched the area.

During the search officers believed Maloney ran into apartment O and was possibly hiding inside the apartment. While standing outside the apartment officers observed movement inside and began ordering the suspect to exit the building. Suspect Maloney complied with the officer’s commands and was taken into custody. During a search of the apartment officers located a semiautomatic 40 caliber handgun under a bed.

During the investigation it was determined that the suspect stole the firearm this morning in South County, and he was previously convicted of a felony with time served in prison. He was booked into county jail for a felon in possession of a loaded firearm, possession of a stolen firearm, and resisting arrest.

He is currently being held in county jail on $80,000 bail.
