Sun Prairie Police Department Media Release - Felony OWI Arrest

Subject: Felony OWI Arrest
At approximately 7:45 pm on Wednesday, July 1st, the Sun Prairie Police Department received a report of a subject that appeared intoxicated in a store. The subject was followed into town by a witness who observed the vehicle driving all over the roadway. The officer located the vehicle and conducted a traffic stop. Contact was made with the driver who was identified as Fausto R. Herrera.
Herrera, age 50 of Marshall, was subsequently arrested for OWI-7th Offense. Because this was his 7th offense and there were minor children in the vehicle, the resulting charge is a felony. He was booked into the Dane County Jail on the felony OWI charge as well as issued citations for Operating Without a License and Open Intoxicants in the vehicle.
Pursuant to the directive of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicity, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until proven guilty.
