Marijuana Enforcement Team & County Code Enforcement serve a search warrant at a medical marijuana dispensary

INCIDENT: Marijuana Dispensary Search Warrant

LOCATION: The Re-Up Collective
20175 N Kendall Drive, San Bernardino

SUSPECT: Tony Xavier Serhal, 26, of Fontana; Luis Javier Mendoza, 23, of Apple Valley; Robert Lobato, 42, of San Bernardino


SUMMARY:
On Wednesday, May 13, 2015, at approximately 9:00 a.m., members of the Sheriff’s Marijuana Enforcement Team and County Code Enforcement served a search warrant at the Re-Up Marijuana Dispensary located in the unincorporated area of San Bernardino and at a residence in Fontana. The dispensary was being operated in violation of the San Bernardino County ordinance prohibiting marijuana dispensaries and continued to operate in defiance of cease and desist notifications.

The search warrant served on Wednesday, May 13th was the result of detectives learning the dispensary owner / operator, Tony Serhal, was selling and distributing marijuana to customers in violation of the county’s ordinance. Through this investigation, detectives discovered Serhal and his employee, Mendoza, were conducting the illegal sales and distribution of marijuana with no regard for the laws applying to medical marijuana. Lobato is employed as a security guard for the dispensary. Large amounts of processed marijuana and cash were recovered at the business and at Serhal’s home in Fontana. Investigators determined Serhal was not following business practices that would be consistent with the California Attorney General’s Medical Marijuana Guidelines and State Laws pertaining to medical marijuana. All of the illicit marijuana, to include concentrated cannabis and edibles, were seized.

Serhal, Mendoza and Lobato were arrested and cite-released at the scene. Upon completion of the investigation, it will be turned over to the San Bernardino County District Attorney’s Office for filing of criminal charges.
