4/23/15, press release: lewd and lascivious conduct

On April 23, 2015 during the early morning hours the Burlington Police Department was called to the report of a Sexual Assault at the suspect’s address on Pearl Street. The victim had locked himself in a bathroom and was communicating with a Vermont 911 dispatcher through text messages on a cell phone.

When officers arrived on scene the victim was located in the bathroom. Responding officers were able to establish that the victim had been in the Downtown area when he was approached by the suspect and another male. When asked, the victim told them he was just looking for some place warm and a place to plug in his phone. The victim was invited back to the suspect’s residence.

The second male left the apartment a short time after they arrived, leaving the victim and suspect alone in the apartment. The victim reported fell asleep and woke to the suspect touching him inappropriately. The victim was able to get away from the suspect and hide in the bathroom until police arrived.

The investigation supported probable cause to arrest and charge the suspect with Lewd and Lascivious Conduct, he was taken into custody, arraigned, and released on conditions.


The maximum penalty for a person found quality of Lewd and Lascivious Conduct is 5 years imprisonment and up to a $300 fine.
