Timothy Gainey, of Marion, charged with breaking into residence, stealing property and setting house ablaze
Detective Lynn Greene of the McDowell County Sheriff’s Office charged Timothy Shane Gainey, 23, of N.C. 226 South in Marion, with one felony count each of arson, breaking and entering, larceny and possession of marijuana.
Early Saturday morning, April 4, McDowell County sheriff’s deputies responded to a house fire on Workman Drive. The owners, Michael Moore and David Cox, told investigators that someone broke into their residence, stole three guns and an iPad and set fire to the kitchen, which killed their dog.
Capt. Shanon Smith said an investigation showed that the blaze was intentionally set. Smith added that Gainey and Moore knew each other from work.
“Detective Lynn Greene developed a suspect,” said Smith. “He and Detective Jason Grindstaff went to Mr. Gainey’s residence, conducted a search and found the property that had been reported stolen.”
When deputies tried to apprehend Gainey, he fled on foot but was apprehended a short time later. During his arrest, officers found approximately 2 ounces of marijuana on Gainey’s person.
All of the stolen property was recovered.
