UNDER AND BY VIRTUE of a Writ of Execution issued by the above named court in the above-entitled action on the 3rd Day of December, 2014, directed to the undersigned Sheriff from the Superior Court of McDowell County, I will offer for sale to the highest bidder for cash whatever right, title, and interest, the judgment debtors owns or may own in the following described real property which is subject to sale under execution.
The real property being sold is described as that certain tract of land lying and being in Nebo Township, McDowell County, North Carolina and being more particularly described in those certain deeds recorded on February 08,2007 in Book CRP 905 Pages 519-520 physical address being 685 Mile Dr., Nebo, NC 28761, McDowell County Registry. Subject to all restrictions, reservations, exceptions, and easements set forth in the above-referenced plats(s) and/or deed(s).
This sale shall be held at the following location as designated by the Clerk of Superior Court: front steps of the McDowell County courthouse, 21 S. Main Street, Marion, NC, on the 3rd day of March, 2015 at 11:30am. This property is being sold “AS IS, WHERE IS” and said sale shall be SUBJECT TO all superior liens, mortgages, easements, encumbrances, unpaid taxes and special assessments which were or became effective on the record prior to the lien of the judgment under which the sale ins being held. There IS a deed of trust or mortgage on file with the Register of Deed on the property.
The judgment debtors HAVE NOT claimed his/her exemptions in this real property. If the debtor has claimed the exemptions, he/she is entitled to receive $35,000 ($60,000 for some debtors) in value from the proceeds of the sale of the property. Sales for an amount less than the exemption claimed shall not be final. The sale shall be held open for ten (10) days for the filing of upset bids as required by law. No sale is final until confirmed by the Clerk of Superior Court of the issuing county.
The property may be subject to debt, restrictions and/or conditions unacceptable to individual bidders. All bidders are encouraged to do a complete title search on this property PRIOR TO entering a bid. The McDowell County Sheriff’s Office, the Sheriff and Deputy Sheriffs, and the county of McDowell make no representations or warranties of any kind or nature with regard to title to or suitability for any purpose or the condition of this real property.
