A Refresher Course- CA State Driver's Permit/Provisional License Overview

Lately there have been quite a few changes to California State Law in regards to minors receiving and maintaining a California State Driver’s License. Below is a condensed list of key points that you should know if your child is soon to be receiving this milestone achievement known as their Provisional Permit and Provisional Driver’s License.

 

Provisional Driver’s Permit-

     The period of time that the unlicensed driver should be learning to drive under the supervision of a parent, guardian, or driving instructor that is of 25 years of age or older.

     This permit is not valid until the provisional driver has started behind-the-wheel driver’s training with a certified instructor.

     With the provisional permit, the driver shall not drive alone.

     Once the provisional driver has reached the state mandated amount of provisional driving hours, they may apply to take the CA DMV driver’s test.

 

Once the provisional driver passes the DMV driver’s test, they receive a provisional license which stays in effect until they are 18.

Provisional Driver’s License-

     The period of time that the provisionally licensed driver can drive with further limited restrictions. These restrictions shall be adhered for the first 12 months after receiving their provisional driver’s license.

     Driver can now drive alone.

     Cannot drive between 11pm and 5 am

     Cannot transport passengers under 20 years of age unless accompanied by parent/guardian or licensed driver 25 years or older.

     There may be exceptions to the above restrictions if:

                Medical necessity (note signed by medical dr)

                School activity (note signed by school principal or dean)

                Employment necessity (note signed by employer)

                Necessity to drive immediate family member (note signed by parent/guardian)
