Lake County-A road rage incident turned ugly when one of the drivers shot at the other driver, late yesterday morning.
Preliminary investigation by Indiana State Police Detective Brian McCall revealed that at approximately 11:00 a.m., yesterday, Tuesday, January 27, 2015, a twenty-eight year old (28) man from Chicago, driving a 2003 Acura, was east bound on I-80/94 when he and another driver became involved in road rage (not letting the other car pass, flipping the driver off etc.). As the Chicago man approached Ripley Street exit he pulled alongside the other driver, later identified as Emmanuel Antonio Ontiveros-Leyva, 24 of South Bend, who was driving a black 1997 BMW in the left lane the next thing the Chicago man knew his back window exploded. As the Chicago man looked left he saw that Ontiveros-Leyva was pointing, what he thought was, a firearm at him and alleges that Ontiveros-Leyva fired a second shot. The Chicago man exited at the Toll Road and called 911 to report the incident.
Master Trooper Jim Burkhart was able to stop Ontiveros-Leyva on east bound I-94 at the 40 mile marker (this is the Michigan City/LaPorte exit). A weapon was located in Ontiveros-Leyva’s vehicle that turned out to be a co2 powered BB gun that looked like a 45 semi automatic handgun.
Ontiveros-Leyva was taken to Lake County jail in Crown Point and charged with Criminal Recklessness, additional charges maybe pending.
