APD arrest couple in Thursday evening burglary in west Amarillo.

On Thursday December 18th at 6:15pm, APD officers were sent to the 3300 block of SW 10th on a possible burglary in progress. Upon arrival officers spoke with the caller, who turns out to be the homeowner’s son. He advised that there were two individuals inside his father’s residence and that he did not know who they were or why they were there. Officers approached the residence and observed a male and female in the living room. Officers asked the couple to come outside and talk to officers and they complied. The male subject Kyle Walter Patton W/M 32 stated that the house belongs to his grandfather. He went on to state that his grandfather has some mental health problems, that his memory is not very good and that his wife had recently passed away. As officers continued their investigation, they learned that the female subject identified as Shelby Brianna Funk W/F 20 was wanted on several outstanding warrants. Funk was handcuffed and placed in the back seat of a police car. Officers then advised Patton that he was being detained in the investigation due to the burglary call. As Patton was being handcuffed, he asked the officer if the officer could retrieve money from his pocket to give to Funk for her bond. The officer complied with the request, did place his hand inside the pocket and discovered narcotic paraphernalia. At that time a more thorough search was conducted and officers located a bag of marijuana in coat pocket that Patton was wearing.

A short time later the homeowner and his wife arrived at the residence. The homeowner stated that he did not know these individuals and did not give them permission to be in his residence.  The couple were transported and booked into Potter County Correction Center. Patton was charged with Burglary of a Habitation, Possession of Marijuana 0ver 2 ounces less than 4 ounces, and Possession of Drug Paraphernalia. Funk was charged with Burglary of a Habitation, and 3 Potter County warrants, one for Unlawfully Carrying a Firearm; one for Fail to ID Fugitive, and a capias pro-fine Class A theft.
