MARKS CHARGED WITH ATTEMPTED MURDER

On Sunday, 8-10-14, Kevin Clifford Marks was released from Mission Memorial Hospital in Asheville and transported to Rutherford County Detention Facility.

Marks was served with warrants for ATTEMPTED MURDER, ASSAULT W/DEADLY WEAPON W/INTENT TO KILL INFLICTING SERIOUS, RESISTING PUBLIC OFFICER and POSSESSION OF FIREARM BY FELON.

Marks received a secured bond of $750,000.00 and is currently being held in the Rutherford County Detention Facility.

Marks will have his first court appearance on Monday, 8-11-2014.

STANDOFF LEADS TO SHOOTING

The Rutherford County Sheriff's Office is in the process of seeking warrants on Kevin Clifford Marks for the following charges...Attempted Murder and Assault with a Deadly Weapon Inflicting Serious Injury with Intent to Kill. The Case is still under investigation. Further charges may be forthcoming.

On 8-4-14 at approximately 7:48pm Rutherford County Sheriff Deputies were dispatched to 171 Oak Forest Drive Forest City, in the Sandy Mush Committee, in reference to a subject having a shotgun and threatening the caller. The caller also advised they thought the subject was on meth.

The subject Kevin Clifford Marks, 49 year old white male, was seen with the gun by arriving officers.

For several hours negotiations were attempted to get Marks to put down his weapon and come out of the house, with no avail.

Just prior to 11:30 pm, deputies with the Rutherford County Sheriff’s Emergency Response Team (S.E.R.T.) attempted to make entry into the residence to take Marks into custody for Possession of Firearm by Felon and Resist, Obstruct and Delay.

Deputies were fired upon by Marks as they attempted to make entry.
Only minor injuries were sustained at that time.

Attempts to regain contact with Marks were unsuccessful.

During this time of silence from Marks, the S.W.A.T. team from the Henderson County Sheriff’s Office had been contacted and arrived on scene.

Rutherford County Sheriff’s Office negotiator re-established verbal contact with Marks in an attempt gain his surrender.

Marks began shooting at officers on scene, and officers returned fire.

The exchange of gun fire resulted in several Rutherford County Sheriff’s Deputies receiving injuries.

Marks also received injuries during the exchange of gunfire.

Three officers were treated on scene by EMS and released; one officer was treated at Rutherford Regional Hospital and released; one officer received gunshot wounds and was sent to Cleveland Regional and later transferred to Carolinas Medical in Charlotte.

Marks was sent to Rutherford Regional and later transferred to Mission Memorial in Asheville for a gunshot wound.

Sheriff Chris Francis requested N.C. State Bureau of Investigation to investigate this incident.
