Commercial Vehicle Driver Placed Out of Service for Alcohol Consumption
Sullivan County—This morning at 0900, Indiana State Police Senior Trooper Mark Overpeck of the ISP Commercial Vehicle Enforcement Division, stopped a white 2015 Volvo tractor pulling a box trailer, northbound on US 41 near 500 North for a following too close violation.
During his conversation with the driver and inspection of the vehicle, Senior Trooper Overpeck noticed the driver smelled of what appeared to be alcohol. Further investigation revealed the driver, Darshan Singh, age 54, of Delhi, California, tested positive for alcohol with a BAC of .063%.
Singh was cited and placed out service for driving a commercial vehicle with a detectible amount of alcohol in his system, which is a Federal Motor Carrier Safety Regulation violation. Singh was also cited for following too closely and driving a commercial vehicle with a BAC between .04% and .07%, both State of Indiana statutes.
Singh was driving for Mike Tamana Freight Lines of Ceres, California. He was hauling frozen vegetables from Oaktown, Indiana to Kendallville, Indiana.
Assisting was ISP Sergeant Chuck Tharp of the Commercial Vehicle Enforcement Division.
Under the Law, criminal charges are merely accusations and the defendant is presumed innocent unless and until proven guilty.
