Emails with Nude Photos Lead to Felony Charges

A yearlong investigation by Indiana State Police Detective Scott Jarvis culminated in the arrest of a man this week for two counts of Dissemination of Matter Harmful to a Minor, a class “D” Felony. An investigation was started in July 2013 after a complaint was made that a Hancock County man had sent nude photos of himself via email, accompanied by lewd messages, to female juveniles in Henry County.

After the investigation was completed it was turned over to Henry County Prosecutor Joe Bergacs, who issued the two count felony warrant for the arrest of Mark Suesz, age 48 of New Palestine. After the warrant was issued investigators discovered that Suesz had moved out of state to North Dakota.

Detective Jarvis received information on Monday of this week that Suesz was visiting relatives in New Palestine in Hancock County. The Hancock County Sheriff’s Department located Suesz at the relative’s home on July 8th and took him into custody. He was transported to and arraigned in Henry County on July 9th.

Jarvis, a fifteen year veteran of the Indiana State Police, stated that “In my fifteen years as an Indiana State Trooper this is by far the most disturbing case that I’ve investigated.” In Indiana a Class “D” Felony charge carries a maximum sentence of up to three years imprisonment and up to a $10,000 fine.
