Carnival Truck Impounded for Overweight and Safety Violations
Sullivan County—This afternoon at 12:45, Indiana State Police Senior Trooper Byron Goodman of the Commercial Vehicle Enforcement Division, was patrolling US 41 in Sullivan County looking for traffic violations related to commercial motor vehicles, when he spotted a 1986 GMC tractor pulling a 1984 homemade trailer northbound on US 41 near State Road 154. Goodman stopped the tractor-trailer and during the commercial vehicle inspection, Goodman found the vehicle was 17, 500 pounds over the registered plate weight of 26,000 pounds for a total unit weight of 43, 500 pounds. Other violations included failure to pay for fuel tax permit, air leaks, no annual inspection, inoperable lighting, damaged tires, no safety equipment and non-working trailer brakes. At the request of Goodman, the tractor-trailer was placed out of service and towed and impounded by Peffley and Hinshaw Wrecker Service of Terre Haute. The unit will be held until the proper registration and permits are obtained, repairs are made to the tractor-trailer, and the overweight trailer is corrected.
The driver was 54-year-old Harold Kelley of Shelburn, Indiana. Kelley was cited for overweight violation and no fuel tax permit. The tractor-trailer was owned by Shortline Amusements of Shelburn, Indiana.

Under the Law, criminal charges are merely accusations and the defendant is presumed innocent unless and until proven guilty.
