Anita Kirby Smith, of Marion, charged with shooting husband in hand during disagreement 
Detective J.T. Grindstaff of the McDowell County Sheriff’s Office charged Anita Kirby Smith, 53, of Riverview Drive in Marion, with felony assault with a deadly weapon with intent to kill inflicting serious injury.
Deputies responded to 3467 U.S. 221 North in Marion shortly before 6 p.m. Thursday to find the victim, 55-year-old Avery Phillip Smith, of U.S. 70 West in Marion, suffering from a gunshot wound to his right hand.
An investigation revealed that Smith and his wife, Anita, had a disagreement and she allegedly brandished a rifle and shot him.
Avery Smith was taken to Mission Hospital in Asheville for treatment of his injuries.
Anita Smith was located Thursday night and taken into custody.
