• 261.5 (c) PC (Unlawful sexual intercourse with a minor being three years or younger than the perpetrator)
• 289(h ) PC (person over 21 participating in act of sexual penetration with another person who is under 18 years old)

VICTIM: 17 year-old, Female, City of Gilroy Resident
SUSPECT #1: Lincoln, Robert William 50 year-old male, City of Capitola Resident


Details:

On 05/06/2013 at approximately 11:06 am, Gilroy Police Officers initiated a continuous sexual molestation case of a minor. During the course of the investigation it was determined that the suspect and victim met at Rancho San Justo Middle School located in the City of Hollister during 2009. Suspect Lincoln was the victim’s Math Teacher. Lincoln befriended the victim and her family since. Lincoln initiated an inappropriate sexual relationship with the victim in 2011 when the victim was 15 years old. These incidents occurred in the City of Hollister and Gilroy. There is no indication that any of the alleged incidents occurred at any school.

Lincoln has not worked as a full-time teacher for the Hollister School district since 2011. It is believed that he may work occasionally as a substitute teacher for the Hollister School District. Lincoln has not worked for the Gilroy School District in any capacity.

Gilroy Police Detectives obtained an arrest warrant for Lincoln listing the noted criminal violations.

On 05/13/2013 at approximately 11:00 am, Lincoln surrendered with his attorney at the Gilroy Police Department. He is currently free after posting 200K Bail.

Gilroy Police Detectives continue to investigate the allegations with the cooperation of the Hollister Police Department and the Hollister School District. This investigation is ongoing and the public is urged to call to report any misconduct that may have gone unreported involving Robert Lincoln.
