On March 29, 2013, at approximately 9:29 am, San Luis Obispo Police Officers responded to the 1200 block of Manzanita for a possible rape that had just occurred. The victim reported that the suspect, later identified as Bryan Kim, was still inside the residence. As responding officers were arriving on scene, Kim was seen driving away in his vehicle by one of the officers. He was stopped a short distance away and detained while officers conducted their preliminary investigation.
The investigation revealed that Kim was a former roommate at the Manzanita residence and had recently moved out. Sometime shortly before 9:30 am, Kim arrived back at the residence and entered the victim’s bedroom where she was sleeping. The victim was awakened by Kim who was naked in her bed and attempting to sexually assault her. At this time victim began to resist his advances and fought back. The victim was able to escape outside and notify the police department prior to Kim leaving.
Both Kim and the victim sustained minor injuries as a result of the assault, none of which required medical treatment. Kim was subsequently arrested and later transported to the San Luis Obispo County Jail. His bail was set at $100.000.00
CHARGES: PC 220, Assault with the intent to commit rape- PC 289(A)(1), Penetration with a foreign object- PC 459, Burglary- PC 236, False Imprisonment- 243.3(A) Sexual Battery.
