Narrative:
On 9/19/2010 at approximately 2 p.m., employees at Office Max on N. Main Street saw a subject take items from a display area and exit the store without paying. Employees recognized the subject as the same person they had seen acting suspiciously in the store the day before. The subject fled when he was confronted by store employees.

A nearby Walnut Creek Police Officer spotted the suspect on the freeway overpass at N. Main Street and Penniman Way. The suspect, who was later identified as Leroy BLACK, matched the description provided by store employees. When the officer attempted to contact BLACK he fled onto the northbound lanes of Highway 680. BLACK ran south on the freeway shoulder before jumping a fence into a condominium complex near the Marriott Hotel. Officers set up a perimeter and searched the area with the assistance of a Police K9. Approximately thirty minutes later BLACK was located in the stairwell of the condominium complex at which point he attempted to flee from officers again. Officers caught up to BLACK and a short struggle ensued. A Police K9 was deployed as BLACK fought with officers. BLACK gave up shortly after he was bit in the arm by the K9.

BLACK was taken into custody and transported to the hospital for injuries resulting from the K9 bite. After he was medically cleared BLACK was booked into county jail in Martinez on the charges listed above.

One officer received minor injuries while chasing BLACK. The injuries did not require hospitalization.

While BLACK was attempting to evade officers he may have changed his clothing. Residents in the area of North Main Street and Parkside Drive are encouraged to contact Walnut Creek PD if they believe their home or car was burglarized during this time period.
